2. Service Description

1. Deliverables:

• The Service includes benchmarking reports as per the selected package (Monthly, Quarterly, Yearly, or Combined).

• Reports compare the Client’s page performance to up to 5 competitors and include actionable insights and recommendations.

2. Automation:

• The Service relies on automated tools and AI-generated insights. While we strive for accuracy, minor discrepancies in data collection or analysis may occur.

3. Subscriptions and Payments

1. Pricing:

• Pricing for the Service is outlined on our website and subject to applicable VAT or taxes.

• The Client is responsible for all taxes, fees, or charges associated with the purchase.

2. Payment Terms:

• Payment is required upfront for all selected packages (Monthly, Quarterly, Yearly, or Combined).

• Subscriptions will not be activated until payment has been received in full.

3. Refund Policy:

• No refunds will be issued once a report has been delivered.

• Clients on subscription plans may cancel before the next billing cycle to avoid future charges.

4. Client Responsibilities

1. Accurate Information:

• The Client must provide accurate information about their page and competitors to ensure the relevance and quality of the reports.

2. Use of Reports:

• Reports are for internal business purposes only and may not be shared, redistributed, or resold without prior written consent.

5. Intellectual Property

1. Ownership:

• All reports, content, and materials delivered as part of the Service remain the intellectual property of Sometrik Oy.

2. License:

• The Client is granted a non-exclusive, non-transferable license to use the reports for their internal business purposes only.

6. Limitations of Liability

1. Accuracy of Data:

• While we strive to provide accurate and reliable insights, the Service relies on third-party data sources. We are not liable for any inaccuracies, omissions, or delays in the data provided.

2. Use of Insights:

• The recommendations and insights in the reports are for informational purposes only. The Client assumes all responsibility for actions taken based on the reports.

3. Maximum Liability:

• Our total liability under any circumstances is limited to the amount paid for the Service during the applicable period.

7. Termination and Cancellation

1. Client-Initiated Termination:

• The Client may cancel their subscription or package at any time. No refunds will be issued for partially completed periods.

2. Company-Initiated Termination:

• We reserve the right to terminate the Service at any time due to a breach of these terms or other justifiable reasons. In such cases, the Client will receive a prorated refund for undelivered reports.

8. Confidentiality

1. Data Protection:

• We will handle the Client’s information in compliance with our Privacy Policy. No data provided by the Client will be shared with third parties without prior consent.

2. Competitor Selection:

• Competitors selected for benchmarking are publicly available pages. No confidential competitor data is accessed or used.

9. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website, and continued use of the Service constitutes acceptance of the new terms.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Finland.
